Jane Doe, a pseudonym for the plaintiff, has filed a lawsuit against a prominent hotel chain and an individual, alleging sexual assault and negligence. The complaint was lodged in Harris County District Court on October 25, 2024, naming MakeReady Experience, RB Houston LLC doing business as Hotel Derek, and Olusegun Adekunle as defendants.
The case stems from an incident that occurred on April 30, 2024. Jane Doe claims she was sexually assaulted by Olusegun Adekunle at Hotel Derek after becoming intoxicated during an evening out with friends. According to the lawsuit, Adekunle followed her into an Uber and added a stop at the hotel without her full awareness. Once there, he allegedly dragged her through the lobby and into his room where the assault took place. Jane Doe's boyfriend later reported the incident to hotel staff and called 911 when he received concerning text messages from her phone.
The plaintiff accuses Hotel Derek and its management company of gross negligence for failing to provide adequate security measures or respond appropriately once they were informed of the ongoing assault. "Hotel Defendants breached their duty by failing to make the condition reasonably safe," states the complaint. It further alleges that employees failed to assist Jane Doe when she was visibly incapacitated in public areas of the hotel.
Jane Doe is seeking over $1 million in damages for medical expenses, pain and suffering, mental anguish, physical impairment, loss of earning capacity, and exemplary damages due to what she describes as conscious indifference by both Adekunle and the hotel operators. She asserts that these actions constitute violations under Texas Penal Code sections related to sexual assault and assault.
