According to the court documents, Rosa Reyes Rivera was shopping at the Family Thrift Center located at 431 Uvalde Road in Houston, Texas, on September 19, 2023. During her visit as an invitee, she suffered severe injuries caused by a sharp edge while browsing through portraits for sale. The plaintiff asserts that Family Thrift Center is liable under the theories of premises liability and negligence. She accuses the defendant of several acts of negligence including allowing dangerous conditions to persist on their premises without adequate warning or correction measures. Rivera argues that these failures breached the duty of care owed to her as a customer and directly resulted in her injuries.
Rivera seeks monetary relief not exceeding $75,000 from Family Thrift Center for damages encompassing past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, lost wages, and loss of earning capacity. She demands a jury trial to adjudicate these claims and seeks both pre-judgment and post-judgment interest along with any other relief deemed appropriate by the court.
