Plaintiffs accuse doctor of unauthorized surgery leading to sterilization

Morgan Jackson and Ricky Jackson Jr. have filed a lawsuit against Dr. Gregory Scott Shelton, MD, accusing him of medical negligence following a surgical procedure that resulted in the unauthorized removal of a healthy reproductive organ. The complaint was filed on October 31, 2024, in the District Court of Harris County, Texas.

The plaintiffs, residents of Hays County, Texas, allege that Dr. Shelton performed an unnecessary and unconsented surgical procedure during a scheduled cesarean section on July 25, 2023. According to the petition, Morgan Jackson was admitted to the hospital for a planned cesarean section and concurrent removal of a left ovarian mass. However, Dr. Shelton allegedly removed her healthy right fallopian tube without her consent or any medical necessity.

The plaintiffs claim that this action has permanently affected Morgan Jackson's ability to conceive naturally and has forced her to consider costly alternatives such as in vitro fertilization (IVF). The discharge summary from July 27, 2023, notes the unintended removal as a result of "miscommunication," which the plaintiffs argue is evidence of negligence.

The lawsuit accuses Dr. Shelton of both negligence and gross negligence for failing to conduct a standard "time-out" procedure before surgery—a critical step meant to confirm the necessity and appropriateness of any surgical actions. This omission allegedly led to an extreme risk and significant harm by removing an organ without authorization.

As part of their legal action, Morgan Jackson and Ricky Jackson Jr. are seeking monetary relief exceeding $1 million for damages including past and future medical expenses, physical pain and suffering, mental anguish, physical impairment, disfigurement, loss of consortium, and punitive damages due to gross negligence.

Representing the plaintiffs is Katherine M. James from The James Law Firm based in The Woodlands, Texas. The case is filed under Case ID 2024-76388 in the 164th District Court with Judge Adiiani Sols presiding over the matter.
