A slip-and-fall incident at a popular grocery store chain has led to a legal battle, with the plaintiff seeking compensation for injuries sustained. Vilma Gomez filed a complaint on November 26, 2024, in the District Court of Harris County, Texas, against ALDI (Texas) LLC D/B/A ALDI, Inc., alleging negligence and premises liability.
The lawsuit arises from an incident that occurred on December 7, 2022, when Gomez visited an ALDI store located at 161 West Road in Houston, Texas. According to the petition, Gomez slipped and fell on a slippery fruit-like substance on the floor of the store. The fall resulted in severe injuries to her body. The plaintiff contends that the dangerous condition was due to negligence by ALDI's employees or agents who failed to maintain and inspect the premises properly. "Defendant maintained or contracted with an unknown third party for the maintenance of the store floors," states the petition. It further alleges that ALDI had knowledge of or should have known about the hazardous condition but failed to take corrective measures.
Gomez's legal team argues that ALDI breached its duty of care by not ensuring a safe environment for its customers. They claim that ALDI failed in several areas: maintaining a safe premise, correcting dangerous conditions promptly, warning invitees about potential hazards, inspecting the premises adequately, training staff properly, implementing effective safety policies, and supervising operations sufficiently. These failures allegedly led to Gomez's injuries and subsequent damages.
In terms of relief sought from the court, Gomez is asking for actual damages including past and future medical expenses; compensation for physical pain and suffering; mental anguish; disfigurement; physical impairment; prejudgment and post-judgment interest; court costs; and any other relief deemed appropriate by the court. The plaintiff is seeking monetary relief not exceeding $250,000 along with non-monetary relief.
