A Houston resident has filed a lawsuit against another local individual following a dog bite incident that allegedly resulted in significant injuries. Moniekia Johnson, the plaintiff, submitted her complaint to the District Court of Harris County, Texas, on November 26, 2024, accusing Cheryl Clark of negligence related to the attack.
The lawsuit centers around an incident that occurred on February 3, 2023. According to the court documents, Johnson was visiting Clark's residence as an invitee when she was bitten by Clark's Shih Tzu dog. The plaintiff claims that Clark failed to control her pet and did not provide any warning about its aggressive tendencies. Johnson asserts that Clark was aware or should have been aware of the dog's dangerous nature and failed to take necessary precautions to prevent harm.
Johnson is pursuing several causes of action against Clark. She alleges negligence and premises liability, stating that Clark owned and harbored the dog responsible for her injuries. Furthermore, Johnson contends that the dog qualifies as a "dangerous dog" under Texas Health and Safety Code § 822.041 due to its unprovoked attack on her. The plaintiff argues that this attack was foreseeable given the dog's history and behavior.
In terms of damages, Johnson seeks compensation for physical pain and mental anguish experienced both in the past and anticipated in the future. She also demands reimbursement for medical expenses incurred due to the injury and anticipates future medical costs.
