Medical Equipment Provider Sues Vibra Hospitals Over Unpaid Rentals

US Med-Equip, LLC has taken legal action against a group of specialty hospitals for allegedly failing to pay over $160,000 in rental fees for medical equipment. The lawsuit was filed by US Med-Equip, LLC on November 27, 2024, in the District Court of Harris County against Vibra Specialty Hospital of Dallas, LLC, Plaza Specialty Hospital, LLC, and CHG Hospital Houston, LLC.

The case centers around unpaid invoices for medical equipment rentals that date back to early 2024. US Med-Equip claims that despite providing necessary medical equipment and support services to these hospitals across Texas and beyond, the defendants have failed to fulfill their financial obligations. According to the complaint, "Defendants have had the use and benefit of equipment rented from Plaintiff but have refused to make payment." The plaintiff asserts that the total outstanding amount owed is $160,928.20.

US Med-Equip's petition outlines several causes of action including breach of contract and unjust enrichment. They argue that valid contracts were in place with each defendant who received goods and services as requested but did not compensate the plaintiff as agreed upon. Furthermore, US Med-Equip contends that it would be inequitable for the defendants to retain benefits from these services without payment.

In seeking relief from the court, US Med-Equip requests actual damages amounting to $145,280.98 plus interest and attorneys' fees. They also seek reasonable attorneys' fees incurred due to engaging legal representation following non-payment by the defendants. The complaint highlights an affidavit by Kerry Whatley which supports their claim as a verified liquidated money demand based on business dealings between both parties.
