Arturo Flores and Rosa Flores have filed a lawsuit against Randall’s Food & Drugs LP, alleging negligence that led to Arturo's terminal cancer. The complaint was lodged in the District Court of Harris County, Texas, on December 4, 2024. The plaintiffs claim that Arturo Flores developed terminal cancer due to chronic exposure to harmful chemicals while working at Randall’s distribution center in Roanoke, Texas.
According to the petition, Arturo Flores began his employment with Randall’s Food & Drugs LP in 2007. During his tenure at the company's warehouse located at 743 Henrietta Creek Road, Roanoke, TX, he was unknowingly exposed to hazardous chemicals. This exposure allegedly resulted in a cancer diagnosis that became apparent around June 1, 2024. The plaintiffs argue that the defendant failed in its duty to provide a safe working environment by not supplying adequate protective equipment or necessary training for handling such dangerous substances.
The lawsuit outlines several allegations against Randall’s Food & Drugs LP. It accuses the company of negligence for failing to provide proper safety equipment and training and not implementing essential safety protocols at the workplace. Furthermore, it claims gross negligence on the part of the defendant for consciously disregarding known risks associated with chemical exposure. As a result of these alleged failures, Arturo Flores is suffering from terminal cancer.
The plaintiffs are seeking monetary relief exceeding $1 million for damages including past and future medical expenses, physical pain and suffering, mental anguish, lost wages and earning capacity, as well as exemplary damages under Texas Civil Practice and Remedies Code § 41.001 et seq. Additionally, Rosa Flores is claiming loss of companionship and consortium due to her husband's deteriorating health.
Representing Arturo and Rosa Flores are attorneys Scott P. Armstrong and Shruti A. Modi from Armstrong Lee & Baker LLP based in Houston, Texas. The case has been assigned Case ID 2024-84584 and will be presided over by a judge from Harris County District Court.
