Flagship Credit Acceptance, LLC has taken legal action against two defendants, accusing them of breaching a contract and wrongfully withholding property. The complaint was filed in the District Court of Harris County on December 13, 2024, naming David Harris and Crown Auto Storage LLC as the defendants.
The case centers around a Motor Vehicle Retail Installment Sales Contract that David Harris entered into on February 22, 2024, with Autos of GPI TX-HGMIYV, Inc., which was subsequently assigned to Flagship Credit Acceptance. Under this contract, Harris financed the purchase of a 2020 Chevrolet Silverado. To secure payment under the contract terms, Harris granted Flagship a first lien purchase money security interest in the vehicle. However, according to Flagship's petition, Harris defaulted by failing to make timely monthly payments. As of November 13, 2024, the outstanding balance due is $26,541.19.
Flagship alleges that despite attempts to repossess the vehicle due to non-payment, their efforts have been thwarted by Crown Auto Storage LLC. The company claims that Crown Auto is exercising wrongful control over the vehicle and has refused to return it despite being notified of Flagship's rightful claim to possession. This refusal forms part of Flagship's conversion claim against Crown Auto.
In addition to seeking recovery of the vehicle and all amounts due under the contract from Harris, Flagship is also requesting judicial foreclosure of its security interest in the vehicle. They are asking for an order granting them possession of the collateral through law enforcement intervention if necessary. Furthermore, they seek actual damages caused by Crown Auto’s alleged conversion of their property and request compensation for attorney’s fees as per Texas Civil Practice and Remedies Code § 38.001 and Texas Property Code § 70.008.
