Plaintiff Accuses Healthcare Facility of Negligence Leading to Resident's Death

Linda Montgomery has taken legal action against a healthcare facility following the tragic death of her aunt, Coreta Foster. The lawsuit was filed on December 13, 2024, in Harris County, Texas, targeting Karissa Healthcare LLC and Fundamental Long Term Care Interim Management LLC for alleged negligence that led to Foster's injuries and subsequent death.

The complaint filed by Linda Montgomery on behalf of the Estate of Coreta Foster alleges severe neglect by Karissa Healthcare LLC, doing business as Bridgecrest Rehabilitation Suites, and Fundamental Long Term Care Interim Management LLC. According to the petition, Coreta Foster was admitted to Bridgecrest Rehabilitation Suites on June 13, 2023. During her stay at the facility, she suffered from numerous health issues including acute pancreatitis and chronic pain. Despite being aware of these conditions and her high risk for falls, the defendants allegedly failed to provide adequate care. On July 2 and July 10 of 2023, Foster experienced unwitnessed falls within the facility. It wasn't until after these incidents that x-rays revealed a "moderately displaced fracture" in her left femur and hip. Consequently, she underwent surgery at Houston Methodist Baytown Hospital before being transferred to Eastview Rehabilitation Center where she passed away on August 1, 2024.

Montgomery claims that the defendants' negligence in failing to properly monitor and care for Foster resulted in substantial injury and damages. She asserts that the healthcare providers breached their duty of care by not maintaining accurate clinical records or formulating adequate service plans tailored to Foster's needs. The lawsuit accuses them of medical negligence under Texas law for failing to exercise appropriate care given Foster's known physical conditions.

In addition to seeking compensation for economic damages such as medical expenses incurred prior to Foster’s death, Montgomery is also pursuing non-economic damages for pain and suffering endured by her aunt due to alleged neglect. Furthermore, she requests punitive damages citing gross negligence on part of the defendants who purportedly prioritized financial gain over patient welfare.
