In a gripping legal battle, an individual is taking on a condominium association over a personal injury incident that has left him with severe injuries. On December 12, 2024, Malak Alshaafi filed a complaint in the District Court of Harris County, Texas, against the Sussex Council of Co-Owners and The Sussex Condominium Association. This case highlights the responsibilities of property owners to maintain safe environments for their invitees.

The plaintiff, Malak Alshaafi, claims that he suffered significant injuries due to negligence on the part of the defendants. According to the petition filed by Alshaafi's attorney Sofia E. Bruera from Bruera Law Firm, PLLC, the incident occurred on August 21, 2023. Alshaafi was reportedly walking through a common area hallway at 7510 Highwood Drive in Houston when he tripped or slipped on a carpeted surface. The lawsuit asserts that this fall resulted in severe bodily injuries and damages to Alshaafi.

Alshaafi accuses the Sussex Council of Co-Owners and The Sussex Condominium Association of failing in their duty as premises owners and managers. He alleges that they did not eliminate or warn about unreasonably dangerous conditions present on their property. "There were no warning signs to alert Plaintiff about the dangerous condition," states the complaint, emphasizing the lack of cautionary measures taken by the defendants.

The plaintiff argues that his injuries were directly caused by these hazardous conditions which should have been known to the defendants or their agents through ordinary care. The complaint outlines several instances of alleged negligence including failure to maintain safe premises, failure to warn about potential hazards, and failure to supervise employees adequately.

In terms of legal relief sought, Alshaafi is pursuing monetary compensation exceeding $250,000 but less than $1 million for his physical pain and suffering, mental anguish, lost wages, medical expenses incurred thus far and anticipated future costs related to his injuries. He has also demanded a jury trial as part of his pursuit for justice.

Representing Alshaafi is attorney Sofia E. Bruera from Bruera Law Firm located in Houston. The case has been assigned Case ID 2024-86550 under Judge Wanda Chambers in Harris County's 133rd District Court.
