Plaintiff Accuses Retail Giant Walmart Of Negligence In Slip-And-Fall Incident

In a compelling legal battle that has caught the attention of many, a Texas resident has taken on one of the largest retail giants in the world over an alleged negligence incident. Debora Urbach filed a lawsuit against Walmart Stores, Inc., Walmart Stores Texas Inc., and associated entities in Harris County District Court on December 17, 2024. The case centers around a slip-and-fall accident that Urbach claims was due to the company's failure to maintain safe premises.

According to the court documents, Debora Urbach alleges that she sustained severe injuries after slipping on an improperly maintained floor at Walmart Neighborhood Market #5094 located at 9700 Hillcroft Street in Houston, Texas. The incident occurred on December 19, 2022. Urbach contends that Walmart and its related entities failed in their duty to ensure a safe environment for customers, leading to her injuries which include fractures to her leg, knee, and foot. The plaintiff's petition states that "Defendants had actual and/or constructive knowledge of the dangerous condition which existed on the floor prior to Plaintiff's fall" but took no action to remedy it or warn patrons.

The lawsuit accuses Walmart of multiple counts of negligence including failing to maintain the premises safely, neglecting proper inspection and monitoring procedures, and not providing adequate warnings about potential hazards. Additionally, Urbach argues that there was a lack of training for employees regarding safety protocols and maintenance plans designed to prevent such incidents. The plaintiff asserts that these failures constitute gross negligence as they involved "an extreme degree of risk" which Walmart was aware of yet disregarded.

Urbach is seeking monetary relief over $250,000 but less than $1 million for damages including physical pain and mental anguish, loss of wages and earning capacity, medical expenses, physical impairment, disfigurement, and loss of enjoyment of life. Furthermore, she requests both prejudgment and post-judgment interest as allowed by law along with court costs.
