Eloisa Reyna Loera has filed a lawsuit seeking over $1 million in damages following an alleged incident involving negligence during medical transport. The complaint was filed on January 16, 2025, by Loera in the District Court of Harris County, Texas, against Christopher Sean McWhirter and Avante Ambulance, Inc.
According to the lawsuit, on October 26, 2024, Eloisa Reyna Loera sustained significant injuries while being transported by Avante Ambulance. The plaintiff claims that McWhirter, the driver employed by Avante Ambulance at the time, failed to secure her properly to the stretcher despite her warnings that she felt like she was falling. This alleged negligence resulted in Loera falling from the stretcher and suffering multiple injuries, including a fractured femur. The complaint states that these injuries have led to ongoing personal suffering and mounting medical expenses for Loera.
The plaintiff accuses McWhirter of negligence and gross negligence for failing to ensure her safety during transport. Specific allegations include not securing the passenger adequately and failing to operate the vehicle safely. Furthermore, Avante Ambulance is accused of negligent hiring practices and failure to train or supervise its employees effectively. The company is also charged with violating local, state, and federal regulations related to vehicle maintenance and operation.
Loera's legal action seeks various forms of relief from the court. She requests compensation for past and future medical expenses, pain and suffering, physical impairment and disfigurement, lost wages, and property damage. Additionally, she seeks exemplary damages due to what she describes as an extreme degree of risk taken by the defendants with conscious indifference towards her safety.
