Amenah Al Bayati has filed a lawsuit against a major automobile insurance company, claiming they failed to fulfill their contractual obligations following a car accident. The complaint was lodged on January 30, 2025, in the District Court of Harris County, Texas, targeting State Farm Mutual Automobile Insurance Company.
The case stems from an incident that occurred on May 20, 2023, when Al Bayati was involved in a motor vehicle collision in Harris County. According to the petition, the accident was caused by an underinsured motorist who collided with Al Bayati's vehicle. The plaintiff asserts that this third-party driver was negligent and violated several provisions of the Texas Transportation Code. As a result of this negligence, Al Bayati suffered significant injuries and damages. The lawsuit details various allegations against the underinsured motorist including failure to maintain proper lookout and speed, which are deemed as negligence per se under state law.
Al Bayati holds an insurance policy with State Farm that includes Underinsured/Uninsured Motorist (UM/UIM) coverage of at least $100,000 per accident. Despite having settled with the underinsured motorist for policy limits, Al Bayati claims that State Farm has not compensated her adequately under her UM/UIM coverage for the injuries sustained in the collision. The plaintiff seeks a declaratory judgment from the court to establish her rights under the insurance contract and confirm her entitlement to recover damages through her UM/UIM coverage.
The relief sought by Al Bayati includes compensation for past and future medical expenses, physical pain and suffering, mental anguish, physical impairment, and loss of earning capacity due to the accident. Additionally, she is pursuing reasonable attorney’s fees and costs associated with bringing this action forward.
