Houston Resident Sues Home Improvement Giant Home Depot Over Negligence

Donald Allen, a Houston resident, has filed a lawsuit against Home Depot U.S.A., Inc., alleging negligence and gross negligence after suffering severe injuries at one of its stores. The complaint was filed on January 30, 2025, in the District Court of Harris County, Texas. Allen claims that Home Depot's failure to maintain safe premises led to his accident and subsequent injuries.

According to the petition, Donald Allen visited a Home Depot store located at 14085 Northwest Freeway in Houston on January 17, 2024. While walking through an aisle, he unexpectedly slipped on a puddle of water that had accumulated on the floor. The fall was so severe that both of his feet left the ground before he collided violently with the hard surface. This incident resulted in significant pain and injury for Allen. He alleges that employees of Home Depot were aware or should have been aware of the hazardous condition but failed to take appropriate action to remedy it or warn customers like him.

Allen's legal filing accuses Home Depot of multiple acts of negligence including negligent hiring, training, supervision, and retention of employees who failed to follow safety protocols. He asserts that these failures directly contributed to his injuries. Furthermore, Allen argues that Home Depot's actions amounted to gross negligence as they exhibited an extreme degree of risk without regard for customer safety.

The plaintiff is seeking monetary relief exceeding $1 million for medical expenses incurred due to the incident as well as anticipated future medical costs. Additionally, he seeks compensation for physical pain and suffering, mental anguish, physical impairment, loss of earnings capacity, disfigurement, exemplary damages, court costs, and pre-judgment and post-judgment interest.
