Despite being informed of the potential risks associated with prostate cancer screening and treatment in elderly patients, Dr. Levey advised monitoring rather than immediate biopsy unless the PSA exceeded 10. Over time, Mr. Miranda's PSA levels fluctuated significantly without appropriate diagnostic follow-up from Dr. Levey. By early 2024, his condition had deteriorated into advanced metastatic prostate cancer.

The plaintiffs argue that Dr. Levey's failure to conduct a timely biopsy or employ adjunctive testing such as MRI or specific blood tests constitutes negligence under medical standards of care. They contend that this oversight allowed Mr. Miranda’s aggressive prostate cancer to progress undiagnosed until it reached an incurable stage with metastasis to lymph nodes and bones by late 2023.

Seeking justice for what they describe as a breach of duty by Dr. Levey and vicarious liability by Memorial Hermann Medical Group under Respondeat Superior doctrine, the Mirandas are pursuing compensatory damages exceeding $1 million for physical pain, mental anguish, loss of consortium, and other related harms.
