Alfreda Louise Simmons has taken legal action against a major retail corporation, claiming negligence after a slip-and-fall incident at one of their stores. On February 13, 2025, Simmons filed a complaint in the District Court of Harris County, Texas, targeting Walmart, Inc. as the defendant.
The lawsuit stems from an incident on May 13, 2003, when Simmons was shopping at a Walmart Supercenter located at 2727 Dunvale Rd., Houston, Texas. According to the complaint, she slipped and fell on a large puddle of water that lacked any warning signs or safety measures such as caution tape or wet floor signage. The absence of these precautions allegedly created a hazardous condition that led to her injuries. "Plaintiff did not have any knowledge of the dangerous condition and could not have reasonably been expected to discover same," the petition states. The plaintiff accuses Walmart of negligence for failing to maintain safe premises and neglecting to warn customers about potential dangers.
Simmons is pursuing claims under premises liability and negligence against Walmart. She argues that Walmart had actual or constructive knowledge of the dangerous condition but failed to take appropriate actions to rectify it or warn patrons like herself. Additionally, she alleges that Walmart's employees were inadequately trained in maintaining store safety standards. The lawsuit asserts that these failures directly contributed to her fall and subsequent injuries.
In terms of relief sought, Simmons demands monetary compensation exceeding $1 million for medical expenses incurred due to past and future treatments related to her injuries. She also seeks damages for physical pain and suffering, loss of earnings and earning capacity, mental anguish, and loss of household services both past and future. Furthermore, she requests pre-judgment interest from the date of injury through judgment day at the maximum legal rate allowed by law.
