In a gripping legal battle unfolding in Harris County, Texas, a local resident has filed a lawsuit against one of the largest retail chains in the country. Timothy McGee initiated legal proceedings against Wal-Mart Stores, Texas, LLC on February 14, 2025, alleging negligence and premises liability that resulted in significant personal injuries.
The complaint was lodged in the District Court of Harris County by Timothy McGee, who claims that an incident at Walmart #522 in Crosby, Texas on July 16, 2023, left him with severe injuries. According to McGee's filing, he encountered a hazardous condition while shopping that caused him to fall. The lawsuit accuses Walmart of being aware—or at least should have been aware—of the dangerous condition but failed to warn customers or rectify the situation. "Defendant’s breach proximately caused Plaintiff's injuries," states the complaint.
McGee is seeking over $1 million in damages for his injuries and related losses. The suit outlines various accusations against Walmart including failure to maintain safe premises and failure to provide adequate warnings about potential hazards. The plaintiff argues that these failures constitute negligence under Texas law. Furthermore, McGee asserts that as an invitee on Walmart's property, he was owed a duty of care which was breached by the defendant.
