A Texas resident is taking legal action against a company and its employee following a car accident that resulted in significant injuries. Christopher Hamilton filed a complaint in the District Court of Harris County, Texas, on February 21, 2025, against Pro-Tech Facility Restoration LLC and Adam Dong Shin.
The lawsuit arises from an incident on March 17, 2023, when Hamilton was involved in a car crash allegedly caused by Shin. According to the complaint, Shin was driving a Dodge Ram 2500 as part of his employment with Pro-Tech Facility Restoration LLC when he lost control of the vehicle due to speeding and unsafe driving conditions. The crash occurred on Highway 288 while both vehicles were traveling southbound. Hamilton's vehicle was struck after Shin's truck hit a concrete barrier and spun out of control. As a result of the collision, Hamilton suffered a torn rotator cuff requiring surgery and continues to experience pain and weakness.
Hamilton accuses Shin of negligence for failing to control speed, keep a proper lookout, operate the vehicle reasonably, pay attention to road conditions, apply brakes timely, and driving recklessly. Furthermore, Hamilton alleges that Shin's actions violated sections of the Texas Transportation Code related to safe driving practices. Additionally, Pro-Tech Facility Restoration LLC is accused under the doctrine of respondeat superior for being liable for Shin’s actions during his employment and negligent entrustment for allowing an incompetent driver like Shin to operate their vehicle.
The plaintiff seeks damages exceeding $500,000 for medical expenses incurred and anticipated future costs due to ongoing medical issues stemming from the accident. Hamilton also claims lost wages and reduced earning capacity because his shoulder injury prevents him from performing physically demanding work as before. He requests compensation for physical pain and suffering, mental anguish, disfigurement, impairment, loss of enjoyment of life as well as exemplary damages citing conscious indifference by defendants towards safety risks.
