A Texas family is taking legal action against property management companies following a dangerous incident at their residence. On February 19, 2025, Hedaia Elbanna filed a complaint in the District Court of Harris County, Texas, against Village at Piney Point, LLC, Excel Property Management LLC, and Texas Excel Property Management Services Corporation.
The lawsuit stems from an incident on January 22, 2024, when Hedaia Elbanna and her minor child were injured due to a ceiling collapse caused by a water leak at their residence located at 2600 Lazy Hollow Drive in Houston. The plaintiffs allege that the defendants failed to address the hazardous condition despite being notified about the water leak prior to the accident. The complaint states that "Defendants had the duty and responsibility not to create and to eliminate and/or warn business invitees of unreasonably dangerous conditions on the premises." The lawsuit accuses the defendants of negligence for failing to maintain safe premises, which resulted in serious bodily injuries to Elbanna and her child.
Elbanna claims that the defendants' negligence included failing to properly maintain the premises, failing to exercise reasonable care to eliminate or warn about dangerous conditions, and failing to provide a safe environment for invitees. Additionally, she argues that the defendants did not adequately inspect the premises for hazards or give sufficient warning about potential dangers. As a result of these alleged failures, Elbanna asserts that she and her child suffered severe physical injuries.
The plaintiffs are seeking monetary relief greater than $250,000 but less than $1 million. They request compensation for physical pain and suffering, mental anguish, disfigurement, lost wages, loss of earning capacity, as well as past and future medical expenses. Furthermore, they demand a jury trial for this case.
