A Texas resident has taken legal action against a well-known beauty retailer, alleging negligence that led to a serious injury. Maribel Hernandez filed a complaint in the District Court of Harris County, Texas, on February 18, 2025, against Ulta Salon, Cosmetics & Fragrance, Inc., claiming damages from an incident that occurred at one of their stores.
The lawsuit stems from an incident on July 8, 2024, when Hernandez visited the Ulta store located at 20530 US Highway 59 North in Humble, Texas. According to the complaint, Hernandez purchased hair and scalp oil and was given a bag with a hole at checkout. The product fell through the hole and spilled onto the floor, causing her to slip and fall. The fall resulted in severe injuries described as "excruciating and painful." Hernandez claims that Ulta failed in its duty to maintain safe premises for customers by not ensuring the integrity of carry-out bags or addressing spills promptly.
Hernandez's lawsuit accuses Ulta of several counts of negligence under premises liability laws. She asserts that Ulta did not exercise ordinary care in maintaining their premises by failing to prevent or clean up spills adequately. The complaint lists multiple failures on Ulta's part: inadequate construction of non-slip surfaces, lack of proper employee training for managing dangerous conditions, and insufficient inspection protocols for carry-out bags. Hernandez argues these oversights directly contributed to her accident and subsequent injuries.
The plaintiff seeks compensation for past and future physical pain, mental anguish, loss of earning capacity, disfigurement, physical impairment, medical expenses, and other economic losses. The damages claimed exceed $250,000 but do not surpass $1 million. Additionally, Hernandez requests both prejudgment and postjudgment interest as permitted by law.
