In a gripping legal battle that underscores the importance of premises safety, a Texas resident has filed a lawsuit against a well-known grocery chain, alleging negligence after suffering injuries on their property. Gerardo Charles initiated the complaint against Fiesta Mart, LLC in the District Court of Harris County, Texas, on May 7, 2025.

The lawsuit arises from an incident that occurred on December 10, 2023, when Charles was shopping at a Fiesta Mart store located at 11006 Airline Drive in Houston. According to the complaint, Charles slipped on water present on the floor of the store and suffered serious bodily injuries as a result. The plaintiff claims that the floor was not slip-resistant and alleges that Fiesta Mart failed to maintain it adequately. This incident forms the basis of Charles's allegations against Fiesta Mart for premises liability and negligence.

Gerardo Charles accuses Fiesta Mart of several negligent acts including allowing dangerous conditions to exist in their store, failing to keep the floor free from slippery substances or liquids, neglecting to inspect for such hazards, and not providing adequate warnings about these dangers. "Defendant owed Plaintiff a duty to exercise ordinary care," states the complaint, emphasizing that Fiesta Mart should have ensured their premises were safe for customers like Charles who are invitees.

Charles is seeking monetary relief capped at $75,000 for various damages incurred due to this incident. These damages include physical pain and mental anguish both past and future, loss of earning capacity and wages both past and future, disfigurement, physical impairment, medical expenses incurred as well as any other damages allowed by law. The plaintiff has also demanded a trial by jury to adjudicate these claims.
