Customer Alleges Negligence Against Grocery Chain Kroger After Slip-and-Fall Incident

A woman is taking legal action against a well-known grocery chain, alleging negligence after suffering injuries from a fall in one of their stores. Mary L. Sam filed a complaint on May 8, 2025, in the District Court of Harris County, Texas, against Kroger Texas L.P., claiming that the store's negligence led to her accident and subsequent injuries.

According to the court documents, Mary L. Sam was shopping at a Kroger store located at 11701 S. Sam Houston Parkway in Houston, Texas, on November 23, 2024. During her visit, she slipped on an unidentified substance on the floor while navigating through the freezer section with her shopping cart. The plaintiff asserts that there were no warning signs about the slippery condition and that the flooring was not slip-resistant. She claims that Kroger failed to maintain a safe environment for its customers by not properly inspecting or addressing hazardous conditions within the store premises.

Sam accuses Kroger of several negligent acts including allowing dangerous conditions to persist, failing to maintain safe flooring conditions by preventing slippery surfaces or debris, and neglecting to inspect and rectify such hazards. Furthermore, she argues that Kroger did not provide adequate warnings about these dangers despite being aware or reasonably expected to be aware of them through ordinary care.

The plaintiff seeks monetary relief under $250,000 for damages incurred due to this incident. This includes compensation for past and future medical expenses, pain and suffering, mental anguish, physical impairment as well as lost wages and loss of earning capacity. In addition to actual damages, Sam is also requesting pre-judgment and post-judgment interest along with court costs.

Represented by attorney Donald G. DeSimone from DeSimone Law Office based in Houston, Texas, Mary L. Sam has demanded a jury trial for this case. The legal proceedings are set under Case ID 2025-32672 with Marilyn Burgess serving as the District Clerk for Harris County.
