A Harris County resident is taking legal action against her property management company, alleging severe health issues due to mold exposure in her apartment. Jill Navarette filed a complaint against Badlands Management LLC in the District Court of Harris County, Texas, on July 18, 2024.
According to the court documents, Navarette began experiencing significant illness and injury around February 28, 2024, which she attributes to mold discovered in her apartment unit. The mold allegedly originated from a damaged pipe during a 2014 remodel of the property. Navarette resided at 3402 Garrott Street Unit S in Houston, Texas, and Badlands Management LLC was responsible for managing and maintaining the premises.
Navarette claims that after discovering toxic levels of mold through an atmospheric test and undergoing medical tests confirming exposure to multiple mycotoxins, she had no choice but to terminate her lease on March 7, 2024. "Defendant knew or should have known of the dangerous condition and neither corrected nor warned Plaintiff of it," states the petition. Navarette accuses Badlands Management LLC of negligence for failing to maintain safe living conditions and not informing tenants about potential hazards.
The plaintiff asserts that Badlands' negligence directly caused her injuries and damages. She seeks compensation for past and future medical expenses, pain and suffering, physical impairment, disfigurement, lost wages, and diminished earning capacity. The lawsuit demands monetary relief exceeding $250,000 but less than $1 million.
Represented by attorneys Kiernan McAlpine and Jonathan Webster from Daspit Law Firm, Navarette requests that the court hold Badlands Management LLC accountable for their alleged negligence under premises liability laws. The case has been assigned Case ID 2024-45065 and will be presided over by Judge Nelson Cuero in the 133rd Judicial District Court.
