Plaintiff Alleges Negligence Against Prominent Mall Management Company Over Slip-and-Fall Incident

A recent court filing has brought to light a significant negligence case involving a well-known property management company and its contractors. On August 22, 2024, Diana Carolina Garza filed a complaint in the District Court of Harris County against Simon Property Group, Inc., DBA Houston Galleria Mall, RCS IWC Holdings, LLC, and National Janitorial Solutions, LLC.

The case stems from an incident that occurred on September 2, 2022. According to the complaint, Garza was walking through the walkway on the third floor of the Houston Galleria Mall when she slipped and fell due to a hazardous substance left on the floor. The plaintiff alleges that this dangerous condition was caused by improper maintenance by National Janitorial Solutions, LLC, which had been retained by Simon Property Group and RCS IWC Holdings for janitorial services at the mall. As a result of this fall, Garza sustained multiple severe injuries.

Garza's lawsuit accuses the defendants of several acts of negligence. These include failing to inspect and remedy dangerous conditions on their premises, failing to warn visitors about these hazards, and failing to properly train their staff. The complaint states: "Defendants owed a duty to use ordinary care, including the duty to protect and guard Plaintiff from unreasonably dangerous conditions." Furthermore, it is alleged that Defendants had actual notice of the hazardous condition but failed to take necessary actions to prevent harm.

In her petition, Garza seeks monetary relief exceeding $250,000 but not more than $1 million. She claims damages for physical pain and suffering (both past and future), mental anguish (both past and future), disfigurement (both past and future), physical impairment (both past and future), and medical expenses (both past and future). The plaintiff argues that her injuries were directly caused by the defendants' negligence in maintaining safe premises for customers.
