Customer Sues Grocery Store Chain Over Slip-and-Fall Incident

A woman is seeking over $1 million in damages after a slip-and-fall incident at a grocery store parking lot. Rhonda Silvas filed the complaint on September 6, 2024, in Harris County District Court against The Kroger Co., Kroger Texas L.P., and Daniel G. Kamin Spring LLC.

According to the court documents, on December 23, 2022, Rhonda Silvas was shopping at a Kroger store located at 5671 Treaschwig Road in Spring, Texas. After completing her shopping, she exited the store and walked towards her vehicle parked in the designated parking lot. Despite clear weather conditions with no precipitation, Silvas encountered a patch of ice formed from water that had flowed from a drainage pipe near the front of the store. The water had pooled and subsequently froze due to improper drainage or defects in the drainage system.

Silvas claims there were no warning signs or markers to alert pedestrians about the hazardous condition. As she walked across the parking lot, she slipped on the ice and fell, sustaining serious injuries to her head and left ankle. These injuries required medical treatment and resulted in pain, suffering, loss of mobility, and other damages.

The lawsuit alleges that The Kroger Co., Kroger Texas L.P., and Daniel G. Kamin Spring LLC failed to maintain their premises safely by not addressing known drainage issues that led to ice formation. "Defendants breached their duty of reasonable care by failing to properly maintain and inspect the drainage system," states Silvas' petition. She further accuses them of negligence for not placing warning signs or taking steps to mitigate the danger posed by ice.

Silvas is seeking monetary relief exceeding $1 million for medical expenses incurred due to her injuries as well as future medical costs, physical pain and suffering (both past and future), mental anguish (both past and future), physical impairment (both past and future), loss of earnings, loss of earning capacity (future), loss of consortium (both past and future), loss of household services (both past and future), disfigurement (both past and future), and costs for medical monitoring.
