A Houston resident has taken legal action against a major corporation following a severe injury at one of its establishments. On September 12, 2024, Anna Tatavak filed a complaint in the Harris County District Court against Metro National Corporation. The lawsuit stems from an incident that occurred on March 17, 2023, where Tatavak claims she sustained serious injuries due to hazardous conditions at the defendant's property.

According to the court documents, Tatavak was shopping as a paying customer at Metro National Corporation’s establishment located at 947 Gessner Rd, Houston, TX. While navigating through the store, she encountered an unmarked wet area on the floor which caused her to slip and fall. The complaint alleges that this hazard was unreasonably dangerous and that the managers and employees of Metro National Corporation either created this hazard or failed to address it despite having sufficient time to do so. “Defendant had a duty to Plaintiff Mrs. Tatavak to provide her with reasonably safe shopping premises,” reads the petition.

Tatavak’s lawsuit accuses Metro National Corporation of both premises liability and common law active negligence. She contends that the company breached its duty by failing to inspect and maintain safe conditions within their property. Specific allegations include creating the hazardous condition, failing to detect it in a timely manner, not marking it adequately for customer safety, and neglecting to clean it up before customers could encounter it. “Defendant’s negligence was the proximate cause of Plaintiff Mrs. Tatavak’s injury and consequent damages,” asserts the filing.

The plaintiff is seeking monetary relief exceeding $250,000 but not more than $1,000,000 for physical pain and suffering, mental anguish, loss of enjoyment of life, physical impairment, disfigurement, loss of household services, and medical expenses incurred due to the incident. Additionally, she seeks pre-judgment interest at the highest rate permitted by Texas law along with post-judgment interest until any judgment is paid in full.

Representing Anna Tatavak is Jeffrey N. Todd from The Todd Law Group PLLC. The case has been assigned Case ID 2024-61781 and will be presided over by Judge Marilyn Burgess in Harris County District Court.
