A Houston resident has filed a lawsuit against a local medical service company, alleging negligence that led to severe injuries. Janet Fullbright lodged the complaint in Harris County District Court on September 13, 2024, targeting Elite Medserve, Inc.
According to the court documents, Fullbright was at Elite Medserve's premises on April 25, 2023, when she encountered an unmarked hazardous condition that caused her to slip and fall. The incident occurred at 6917 Martin Luther King Blvd in Houston. Fullbright asserts that the hazard was not only unmarked but also unseen, leading directly to her fall and subsequent serious injuries. She claims that the hazardous condition had existed long enough for Elite Medserve’s managers and employees to have discovered and rectified it.
Fullbright's lawsuit details how she believes Elite Medserve failed in its duty of care by not marking or fixing the dangerous condition. "Defendant’s managers and employees violated established safety policies and procedures," states the complaint. The plaintiff argues that as an invitee on the premises, she was owed a duty of care which was breached through negligent acts or omissions by Elite Medserve’s staff. These failures included not adequately marking the hazard with safety cones or signs and not cleaning up the dangerous area.
The plaintiff is seeking monetary relief exceeding $250,000 but not more than $1,000,000 for physical pain and suffering, mental anguish, loss of enjoyment of life, physical impairment, disfigurement, loss of household services, and future medical expenses. Additionally, Fullbright requests pre-judgment interest at the highest legal rate along with post-judgment interest until any awarded judgment is fully paid.
