Tenant Sues Apartment Complex Over Negligence Leading to Serious Injuries

A Harris County resident has filed a lawsuit against her apartment complex and its management company, alleging negligence that led to serious injuries. Katherine Mayorga lodged the complaint in the District Court of Harris County on September 13, 2024, targeting Ashford Glens, LP d/b/a Ashford Glens Apartments and HK Capital Management, L.P.

According to the court documents, the incident occurred on September 21, 2022. Mayorga was visiting an apartment at Ashford Glen Apartments located at 1502 Pech Road in Houston when she slipped on water in the entryway while holding her baby. The fall resulted in significant injuries that required medical treatment. Mayorga claims that after her fall, the manager escorting her mentioned there was broken plumbing in the apartment. This revelation forms a critical part of her case as it indicates prior knowledge of a hazardous condition by the defendants.

Mayorga's petition outlines several allegations against Ashford Glens and HK Capital Management. She accuses them of failing to warn invitees about the dangers posed by unreasonably dangerous conditions on their premises and not inspecting or maintaining the floor properly. The complaint states: "Defendants were negligent in one or more respects including failing to warn invitees of hazards, failing to inspect and maintain the floor, and allowing a dangerous condition to exist." Furthermore, Mayorga argues that these actions constitute gross negligence as defined under Texas law because they involved an extreme degree of risk with actual awareness but conscious indifference to her safety.

The plaintiff is seeking monetary relief exceeding $1 million for various damages including past and future medical expenses, physical pain and suffering, mental anguish, physical impairment, disfigurement, and exemplary damages. Additionally, she requests both pre-judgment and post-judgment interest on all awarded damages.

Representing Katherine Mayorga are attorneys Jeffrey R. Johnson and Kyle N. Baysinger from Heil Law Firm based in Corpus Christi. The case is being presided over by Judge Marilyn Burgess in Harris County's District Court under Case ID 2024-62557.
