Customer Sues Retail Chain Over Negligence After Store Injury

Rhonda Brown Rollins has taken legal action against a major retail chain, alleging negligence after suffering injuries at one of its stores. On September 25, 2024, Rhonda Brown Rollins filed a complaint in the District Court of Harris County against Family Dollar Stores of Texas, LLC, operating as Family Dollar #11138.

The lawsuit stems from an incident on May 30, 2024, when Rollins was visiting the Family Dollar store located at 3302 Liberty Road in Houston, Texas. According to the complaint, while exiting the premises, she tripped and fell due to a hazardous mat near the exit. The plaintiff claims that Family Dollar was aware of this dangerous condition because it had been previously reported by one of their employees or agents. Despite this knowledge, the defendant allegedly failed to remedy the situation or warn customers like Rollins about the potential danger.

Rollins accuses Family Dollar of negligence under premises liability law. She argues that as an invitee on the property, she should have been protected from unreasonable risks such as the one posed by the hazardous mat. The complaint highlights that Family Dollar’s failure to maintain safe conditions directly led to her injuries and subsequent damages.

In her petition for relief, Rollins seeks actual and special damages totaling less than $250,000 but not exceeding $74,999. Additionally, she requests compensation for past and future medical expenses, pain and suffering endured both in the past and anticipated in the future, as well as mental anguish experienced due to the incident. Furthermore, Rollins is asking for pre-judgment interest from thirty days after her claim became payable until judgment is rendered and post-judgment interest until full payment is made.
