Houston Restaurant Accused of Negligence After Patron's Injury

A Houston resident has taken legal action against a local restaurant, alleging negligence after suffering injuries on its premises. Joseph Anderson filed a complaint in the District Court of Harris County, Texas, on October 1, 2024, against The Turkey Leg Hut & Company LLC. The lawsuit centers around an incident that occurred at the popular dining establishment in November 2022.

According to the petition filed by Anderson, he was visiting The Turkey Leg Hut as an invitee when he slipped and fell due to uneven ground at the restaurant's location on Almeda Road in Houston. Anderson claims that there were no warning signs to alert patrons of the hazardous condition, which led to his fall and subsequent serious injuries. "The damages and injuries resulting therefrom were not caused by or contributed to by Plaintiff or an innocent third party," the document states, emphasizing that Anderson holds the restaurant responsible for failing to maintain safe premises.

Anderson accuses The Turkey Leg Hut of negligence under several counts: failing to inspect and maintain safe conditions, neglecting to warn patrons about potential dangers, and creating unsafe conditions. He argues that these failures breached their duty of care owed to him as a business invitee. Furthermore, Anderson alleges that the company is liable for the actions of its employees under the doctrine of respondeat superior since they were acting within their employment scope during the incident.

In addition to seeking monetary compensation ranging from $250,000 to $1 million for medical expenses, pain and suffering, and other damages incurred due to his injuries, Anderson also seeks exemplary damages. He argues that The Turkey Leg Hut's actions demonstrated a reckless disregard for safety standards and constituted gross negligence. "Defendant was objectively aware of the extreme risk posed by its conduct," asserts Anderson in his filing.

Represented by attorney Belashia Wallace from The Wallace Law Firm PLLC based in Houston, Joseph Anderson is pursuing both pre-judgment and post-judgment interest along with court costs as part of his relief sought from this legal action. As per court records, this case is assigned Case ID 2024-67838 in Harris County's 133rd Judicial District Court.
