On January 2, 2025, Bonifacio Temoxtle Chipahua filed a complaint against International Do Foods (IDF), Inc. in the District Court of Harris County, Texas. The case highlights serious accusations of negligence on the part of IDF, Inc., which Chipahua claims resulted in significant personal injuries.
The incident at the heart of this lawsuit occurred on August 22, 2024, at IDF's business premises located at 101 Chartes Street, Houston, Texas. Bonifacio Temoxtle Chipahua was employed by IDF at the time and suffered severe injuries while attempting to move a fan positioned behind a fryer. The safety guard of the fan was damaged, leading to Chipahua's right hand middle finger being caught in the blades. This accident caused him serious bodily harm, prompting him to seek legal recourse against his employer.
Chipahua's petition outlines several allegations against International Do Foods (IDF), Inc., accusing them of negligence that directly contributed to his injuries. The plaintiff argues that IDF failed in multiple areas: they did not provide adequate training or supervision; they neglected to ensure a safe working environment; and they did not properly inspect or repair equipment and monitor the work site. These failures, according to Chipahua’s claim, constitute acts of omission and commission that are legally considered negligent under Texas law.
In terms of relief sought from the court, Chipahua is demanding monetary compensation exceeding $250,000 but less than $1 million. This amount covers various damages including past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, as well as lost wages and diminished earning capacity. Additionally, he requests pre- and post-judgment interest along with any other relief deemed appropriate by the court.
