Gloria Palmer has filed a lawsuit against a well-known restaurant chain, alleging negligence that led to significant personal injuries. The complaint was filed by Palmer in the District Court of Harris County, Texas, on January 30, 2025, naming Luby’s Restaurant Corporation as the defendant.
The incident at the heart of this legal battle occurred on July 11, 2024. Gloria Palmer claims she sustained severe injuries after tripping over a folded door mat at the entrance of Luby's Restaurant located at 19668 Northwest Freeway in Houston, Texas. According to Palmer's petition, the fall resulted in a broken shoulder and head injury. The plaintiff argues that Luby’s Restaurant Corporation failed to maintain safe premises and neglected its duty to warn customers about potential hazards.
Palmer's lawsuit accuses Luby’s of premises liability and gross negligence. She asserts that the restaurant was aware or should have been aware of the dangerous condition posed by the folded mat but did nothing to rectify it or warn patrons. "Defendant knew or should have known of the dangerous condition on its premises," states Palmer's filing. Furthermore, she claims that Luby’s acted with "conscious indifference" towards her safety and welfare by allowing such conditions to persist without warning or correction.
In her pursuit of justice, Palmer is seeking damages for past and future medical expenses, physical pain and suffering, mental anguish, physical impairment, disfigurement, and both pre-judgment and post-judgment interest. The lawsuit specifies that she seeks an amount less than $250,000 in total damages but also requests exemplary damages due to what she perceives as gross negligence on behalf of Luby’s.
