Tenant Sues Property Owner Over Dangerous Conditions Leading to Injury

Stephanie Evans-Nesiama has filed a lawsuit against Madeline Kaplan and Monteleone Investments, LLC, alleging negligence and premises liability after suffering severe injuries due to a dangerous condition on the defendants' property. The complaint was filed in the District Court of Harris County, Texas, on January 30, 2025.

According to the petition, Stephanie Evans-Nesiama was injured on March 25, 2024, while residing at a property owned by Monteleone Investments. The plaintiff claims that the bathtub in her apartment began caving in, creating an unreasonably dangerous condition that led to her slipping and sustaining serious injuries. Despite notifying the defendants about the issue weeks prior, no adequate repairs were made. The plaintiff asserts that both Madeline Kaplan and Monteleone Investments failed to exercise ordinary care by not addressing or warning her about the hazardous condition.

Evans-Nesiama's lawsuit accuses Kaplan and Monteleone Investments of several negligent acts including failing to maintain safe premises, neglecting to warn of existing dangers, and not ensuring proper safety measures were in place. The plaintiff argues that these failures directly resulted in her injuries and seeks damages for past and future medical expenses, lost wages, physical pain and suffering, mental anguish, physical impairment, and psychological treatment costs. She is requesting monetary relief exceeding $250,000 but not more than $1 million.

The petition also invokes the doctrine of respondeat superior, holding Kaplan accountable for the actions of any agents or employees involved in maintaining the property. Additionally, Evans-Nesiama demands pre-judgment and post-judgment interest as permitted by law.
