The complaint details an unfortunate event on July 29, 2023, when Augustina Velazquez was shopping at a Home Depot store located at 14085 Northwest Freeway in Houston, Texas. According to Velazquez's account, she slipped on a wet and slippery substance on the floor of the store—a condition she claims was known or should have been known by Home Depot employees. This slip-and-fall incident is at the heart of her lawsuit as she accuses Home Depot of negligence and failing to maintain safe premises for its customers. "Defendant allowed the dangerous condition posed by the wet, slippery surface despite knowing or having reason to know about it," asserts Velazquez in her petition.
Velazquez argues that Home Depot breached its duty of care by not ensuring that their premises were free from hazards such as slippery substances. The plaintiff further alleges that Home Depot failed to inspect and rectify these conditions or provide adequate warnings to customers like herself.
