In a compelling legal confrontation, two Texas residents have taken on a major insurance company over an alleged failure to honor an underinsured motorist claim. Alize Monique Davis and Elizabeth Marie Manning filed a lawsuit against State Farm Mutual Automobile Insurance Company in the District Court of Harris County, Texas, on March 7, 2025. The plaintiffs accuse the insurance giant of failing to uphold its contractual obligations following a car accident that left them with severe injuries.
The case stems from an incident on February 11, 2024, when Davis and Manning were involved in a collision with an underinsured driver. At the time of the accident, they were covered by a State Farm policy that included provisions for underinsured motorist coverage. According to the complaint, despite meeting all policy conditions and notifying State Farm of their claim, the company did not fairly evaluate or settle their claim. The plaintiffs argue that this constitutes a breach of contract and violates several provisions of the Texas Insurance Code.
The lawsuit details multiple allegations against State Farm, including unfair insurance settlement practices such as misrepresenting material facts related to coverage and failing to conduct reasonable investigations into claims. Additionally, it accuses State Farm of breaching its duty of good faith and fair dealing by denying benefits without proper investigation and delaying payments unjustly. The plaintiffs contend that these actions have caused them significant financial and emotional distress.
Davis and Manning are seeking monetary relief ranging from $250,000 to $1 million for medical expenses, lost earnings, physical pain and suffering, mental anguish, and other damages incurred due to the accident.
