A former employee is taking legal action against a Texas-based fitness company, alleging breach of contract and fraud. On March 7, 2025, Danielle Delvige filed a complaint in the District Court of Harris County, Texas, against Method Pilates, LLC and its owner Ashton Verrengia. Delvige claims that she was promised a profit-sharing agreement that was never honored.
According to the lawsuit, Danielle Delvige worked for Method Pilates from October 1, 2016, until her termination on November 1, 2024. During her tenure as Program Director/Manager, she claims to have played a pivotal role in building and managing the company's brand. In 2017, Delvige alleges that she entered into a verbal and implied contractual agreement with Ashton Verrengia for a 10% profit share in exchange for her contributions to the business. These contributions included developing training materials and operational management systems. However, Delvige accuses Verrengia of failing to honor this agreement from 2018 onwards by modifying her compensation structure without consent and instead offering arbitrary "bonus" payments.
The complaint further states that Delvige's termination came immediately after she questioned the missing profit-sharing payments. She believes this action was retaliatory and aimed at silencing her attempts to enforce her contractual rights. Furthermore, she accuses Verrengia of establishing a separate LLC for a new Austin location to deliberately exclude her from any profit-sharing benefits. As a result of these actions, Delvige claims significant financial damages and emotional distress.
Delvige's lawsuit seeks several forms of relief from the court. She demands actual damages for unpaid profit shares dating back to 2018, interest on these amounts as per Texas law, economic and compensatory damages for emotional distress caused by the defendants' actions, exemplary damages due to their alleged willful conduct, as well as attorney fees and court costs.
