BEAUMONT – More than three years after a deadly explosion at its Beaumont, Texas, refinery, ExxonMobil has settled negligence lawsuits filed by the parents of two workers who were killed and six others who were injured in the April 17, 2013 blast. In February 2013, the widow of Ernest Lewis filed a lawsuit against ExxonMobil and Mobil Oil Refining, claiming the companies negligently exposed him to the hazardous chemical benzene. On Sept. 22 a joint motion for dismissal with prejudice was filed in the case, stating the settlement of the matter is solely for claims for the recovery of punitive damages.
Discovery continues in a toxic tort claim brought by Johnny and Rebecca Grove, who sued 18 companies alleging benzene exposure. The suit was filed Feb. 23 in Jefferson County District Court. The defendants named in the suit include, Bridgestone, Canadianoxy Offshore, Chevron and its subsidiaries, Conoco Phillips, DuPont, ExxonMobil, Firestone, Goodyear, Gulf Oil, Huntsman, PPG, Texaco, Total Petrochemicals, Union Oil and United States Steel. An area resident has brought a lawsuit against ExxonMobil, seeking no more than $200,000 damages after he tripped on landscaping paper more than a year ago. John Hart filed the suit June 24 in Jefferson County District Court. According to his lawsuit, on Dec. 25, 2013, Hart, while at the direction and control of ExxonMobil, was a walking along a fence line when he tripped and feel over landscaping paper that was covered up by rocks.

By DAVID YATES Total Petrochemicals & Refining USA was recently non-suited from a benzene lawsuit brought by local residents Robert Fontenot and his wife, who sued Total and 15 other companies for allegedly exposing Fontenot to benzene throughout his career. The suit was filed Feb. 4, 2014, in Jefferson County District Court. Court records show the plaintiffs filed a notice of non-suit on May 7, stating they no longer wished to pursue their claims against Total.
