A Texas resident has filed a lawsuit against two companies, alleging negligence after suffering injuries on their property. Astrid Escalante initiated the legal action on February 6, 2025, in the District Court of Harris County, Texas, targeting Landmark BC Apartments, LLC and Vidaltia Property Management, LLC.
The case revolves around an incident that occurred on November 29, 2024. On this date, Escalante was visiting Grand Palms Apartments in Houston when she fell down a staircase due to what she claims was negligent maintenance by the defendants. The lawsuit contends that the defendants failed to maintain safe premises and did not provide adequate warnings about potential hazards. Escalante asserts that these oversights led directly to her serious bodily injuries. The plaintiff's petition highlights that there were no warning signs alerting her to any dangerous conditions at the time of her fall.
Escalante accuses the defendants of several acts of negligence including creating an unreasonably dangerous condition, failing to inspect and maintain the premises safely, and neglecting to warn visitors about existing dangers. She argues that as an invitee on the property, she was owed a duty of care by the defendants which they failed to uphold. The complaint emphasizes that the defendants either knew or should have known about the hazardous conditions but did nothing to remedy them or warn visitors like Escalante.
In terms of relief sought from the court, Escalante is asking for monetary compensation exceeding the minimum jurisdictional limits for medical expenses incurred and anticipated future costs related to her injuries. Additionally, she seeks damages for physical pain and suffering, mental anguish both past and future, disfigurement, physical impairment, lost wages, and other related out-of-pocket expenses. Furthermore, she demands exemplary damages as well as pre-judgment and post-judgment interest along with all court costs.
