Plaintiff Alleges Multiple Companies Negligent After Workplace Electrocution Incident

In a harrowing case of alleged workplace negligence, a Texas resident has filed a lawsuit against multiple companies after suffering severe injuries on the job. Otoniel Perdomo Rapalo lodged the complaint in the District Court of Harris County, Texas, on February 28, 2025, targeting SKC - Store, Inc., doing business as Kemah Food Mart, L.L.C., F.A.M. Salazar Group, L.L.C., Diaz Enterprizes, Inc., and Seven Up Foods, Inc.

The incident that sparked this legal battle occurred on September 5, 2023. Mr. Perdomo Rapalo was working at Kemah Food Mart in Kemah, Texas when he was instructed by the store owner to perform electrical work despite having no experience or certification in this field. According to the petition, Mr. Perdomo Rapalo was assured that the task was safe and that the power had been shut off. Tragically, this assurance proved false; while attempting to cut wires in the ceiling, he was violently electrocuted and fell from an eight-foot ladder. The fall rendered him unconscious and caused significant bodily harm.

Mr. Perdomo Rapalo accuses the defendants of failing to maintain a safe work environment and neglecting their duty of care towards him as an employee. He claims they did not inspect or eliminate hazardous conditions at the site nor provide adequate warnings about potential dangers. As a result of these alleged failures, Mr. Perdomo Rapalo suffered extensive injuries leading to ongoing medical expenses and personal suffering.

Seeking justice for his ordeal, Mr. Perdomo Rapalo is pursuing over $1 million in damages for past and future medical expenses, physical pain and suffering, loss of earnings and earning capacity, loss of consortium with his family due to his injuries, and other related damages. Additionally, he requests exemplary damages based on what he describes as conscious indifference by the defendants towards his safety.
