Plaintiff Alleges Negligence Against Retail Giant Walmart Following Slip-and-Fall Incident

Rafael Alanis has filed a lawsuit against Walmart Stores Inc., claiming negligence after suffering severe injuries from a slip and fall incident at one of their stores. The complaint was filed on February 26, 2025, in the District Court of Harris County, Texas. Alanis alleges that Walmart failed to maintain safe premises, leading to his accident.

The incident occurred on May 31, 2024, when Rafael Alanis visited the Walmart Supercenter located at 1383 N Fry Rd, Katy, TX. After purchasing groceries, he slipped on a spilled substance near an ice machine as he exited the store. This fall resulted in serious injuries for which Alanis holds Walmart accountable. He claims that the company neglected its duty to ensure customer safety by not maintaining clean floors or warning customers about potential hazards. "Defendant breached this duty not only by failing to maintain and inspect its floors and aisles but also by failing to warn its customers of unreasonable risks of harm," states the petition.

Alanis is seeking monetary relief exceeding $1 million due to his injuries and associated damages. He argues that Walmart's negligence is evident through several acts or omissions such as creating hazardous conditions without adequate warnings and failing to properly manage their premises. Furthermore, Alanis accuses Walmart of violating multiple safety laws including the Texas Health and Safety Code § 341.011 and Texas Property Code § 92.056 by not addressing dangerous conditions promptly.

The plaintiff demands compensation for medical expenses incurred and expected in the future, physical pain and suffering, mental anguish, loss of earnings capacity, and other related damages. Additionally, Alanis seeks exemplary damages due to what he describes as Walmart's conscious indifference towards customer safety. His legal representation argues that these actions involved an extreme degree of risk which was ignored by the defendant.
