A Harris County resident has taken legal action against a major grocery chain, alleging negligence that led to personal injury. Elizabeth Castro Obando filed a complaint on February 27, 2025, in the District Court of Harris County, Texas, against H-E-B, LP. The lawsuit centers around an incident that occurred at one of the defendant's stores in Houston.
According to the court documents, the events unfolded on July 22, 2023, when Elizabeth Castro Obando was shopping at an H-E-B store located at 10100 Beechnut Street in Houston. As she navigated through the aisles near the rotisserie chicken food warmers, she slipped on a wet and slippery substance on the floor. This fall resulted in significant bodily injuries for Obando. The plaintiff claims that H-E-B was negligent in maintaining safe premises for its customers and failed to address or warn about hazardous conditions within their store. "Defendant allowed a dangerous condition posed by the wet, slippery substance despite knowing or should have known of its existence," states the petition.
The lawsuit accuses H-E-B of several acts of negligence under Texas common law. These include allowing dangerous conditions to persist, failing to inspect and maintain safe premises, and not providing adequate warnings about potential hazards. Obando asserts that as an invitee at the time of her injury, she was owed a duty of care by H-E-B to ensure a reasonably safe environment. The plaintiff's legal team argues that this duty was breached due to negligence by H-E-B employees who had control over the premises.
Elizabeth Castro Obando is seeking monetary relief exceeding $250,000 but less than $1 million for damages incurred from her injuries. These damages encompass past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, lost wages, and diminished earning capacity. Additionally, she requests pre-judgment interest and post-judgment interest as part of her compensation package.
