Customer Sues Fiesta Mart for Negligence Following Slip-and-Fall Incident

A recent court filing has brought to light serious allegations of negligence against a prominent Texas business. On September 11, 2024, Timotea Osores filed a complaint in the District Court of Harris County, Texas, accusing Fiesta Mart, L.L.C. of negligence that resulted in personal injuries sustained by Osores.

According to the complaint, the incident occurred on July 17, 2023, at Fiesta Mart's premises located at 2323 Wirt Road, Houston, Texas. Osores alleges that while she was an invitee at the store, she slipped and fell due to a slick substance on the floor. The plaintiff claims there were no warning signs or any other indications of caution near the area where the incident took place. As stated in the filing: "Plaintiff was not aware of the dangerous and defective condition." Osores contends that Fiesta Mart knew or should have known about this hazardous condition but failed to either correct it or warn her about it.

The lawsuit outlines several accusations against Fiesta Mart under premises liability and negligence theories. It asserts that Fiesta Mart failed to maintain its premises in a reasonably safe condition, neglected to inspect areas where dangerous conditions existed, did not take reasonable measures to safeguard customers entering the premises, and failed to inform Osores of the hazardous situation. Each of these negligent acts is claimed to be a proximate cause of Osores' injuries and damages.

Osores is seeking monetary relief exceeding $250,000 but not more than $1,000,000 for past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, as well as lost wages and loss of earning capacity. Additionally, she seeks pre-judgment and post-judgment interest along with all court costs.
